The Control of Asbestos at Work Regulations 2002 came into force on
21st November 2002 to replace the 1987 Regulations.
The 2002 Regulations
include a requirement (Regulation 4) on the dutyholder to make an assessment
as to whether asbestos is or is liable to be present in non-domestic
premises occupied by him and in which persons work.
The new Regulation places an explicit duty on people in control of premises
which requires them to:
- take reasonable steps to locate materials likely to contain asbestos
and check their condition;
- presume that materials contain asbestos unless there is strong evidence
to suppose that they do not;
- make a written record of the location and condition of asbestos and
presumed asbestos containing materials (ACMs) and keep the record up
to date;
- assess the risk of the likelihood of anyone being exposed to these
materials;
- prepare a plan to manage the risk and put it into effect to ensure
that:
- any material known or presumed to contain asbestos is kept in a good
state of repair;
- any material that contains or is presumed to contain asbestos is,
because of the risks associated with its location or condition, repaired
or if necessary removed;
- information on the location and condition of the material is given
to anyone potentially at risk.
